Terms of use of the Quanta platform
Complete English translation of the published German Terms and Conditions, version 2.5, dated 16 October 2026. References to German and European law are retained from the published original.
(1) These General Terms and Conditions (the ‘Terms’) govern use of the ‘Quanta’ learning platform (the ‘Platform’), operated by:
AM Creative Tech UG (haftungsbeschränkt)
Herweghstr. 8, 01157 Dresden, Germany
Telephone: +49 151 15434471
Email: amos@am-creativetech.com
Commercial register: HRB 47813, Amtsgericht Dresden
Managing director: Amos Matzke
(2) The Platform is intended for consumers and businesses (§§ 13, 14 BGB). Any conflicting terms and conditions of the user do not apply.
(1) Quanta is a web-based learning platform for school, vocational training, university studies and continuing professional education. It is not restricted to particular disciplines and is used, among other areas, for science and technology, languages, the humanities and social sciences, and medical and nursing subjects. The Platform offers the following features, among others:
(2) The available features depend on the selected plan (the free Starter plan or one of the paid plans Essential and Performance ).
(1) Registration is required to use the Platform. Users must provide truthful information and keep their passwords confidential.
(2) Each user may create only one account. Login credentials must not be disclosed to third parties.
(3) Users under the age of 16 may use Quanta with a limited range of features. For their private accounts, AI features are enabled only after a parent or legal guardian has explicitly consented; the provider obtains this consent through a dedicated consent process. This does not apply to accounts created or assigned by invitation through an educational institution: the institution obtains the necessary consents itself (§ 16(4)), and the provider does not separately check the age and consent of these accounts. Further statutory requirements, particularly those concerning the representation of minors, remain unaffected.
(1) The Platform offers the following plan options:
(2) The student discount is ten per cent of the price for the selected term. It can be selected using the toggle without proof of student status; individually promised existing prices remain unchanged. Time-limited promotional discounts may be offered separately.
(3) All prices include statutory VAT. Current prices are available in the ‘Pricing’ section of the Platform.
(1) Payments are processed by the payment service provider Stripe. Accepted payment methods are shown during checkout.
(2) Trial period. When a user first subscribes to a paid plan, the provider grants a free trial of 7 days. Each account receives this trial only once, regardless of the subscription term chosen or any subsequent change of term. A payment method is registered for the trial but is not charged; before the purchase is completed, checkout shows the earliest possible date of the first charge. When the trial ends, the contract automatically continues on the selected paid plan without any further declaration, and payment for the first billing period becomes due. Users may cancel at any time during the trial; access then remains available until the end of the trial and no payment is due. If an account has already used the trial, checkout shows the amount payable immediately.
(3) Payment is collected in advance for each billing period (monthly, half-yearly or annual), initially when the trial ends or, if there is no trial, when the contract is concluded.
(4) If a payment fails, access to paid-plan features may be restricted.
Information on the right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date on which the contract is concluded.
To exercise your right of withdrawal, you must inform us (AM Creative Tech UG (haftungsbeschränkt), Herweghstr. 8, 01157 Dresden, telephone: +49 151 15434471, email: amos@am-creativetech.com) of your decision to withdraw from this contract by an unambiguous statement, for example a letter sent by post or an email. You may use the attached model withdrawal form, but it is not compulsory. You may also exercise your right of withdrawal online at quanta-study.de/en/withdraw. If you use this online function, we will promptly provide an acknowledgement of receipt on a durable medium, for example by email, containing the content of your withdrawal notice and the date and time it was received.
To meet the withdrawal deadline, it is sufficient to send your notice exercising the right of withdrawal before the withdrawal period expires.
Effects of withdrawal
If you withdraw from this contract, we must reimburse all payments received from you without undue delay and no later than fourteen days after the day on which we receive your notice of withdrawal. We will use the same payment method you used for the original transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees for the reimbursement.
If you requested that services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you inform us that you are exercising your right of withdrawal, compared with the full scope of services specified in the contract.
End of the information on the right of withdrawal
Immediate start of service and proportionate payment
Access to the Platform is a digital service that begins when the contract is concluded. The provider offers paid subscriptions only with an immediate start of service: before checkout begins, the user expressly requests that the provider start supplying the service immediately and acknowledges that, in the event of withdrawal, a proportionate amount is payable for the service already supplied (§ 357a(2) BGB). Without this request, checkout cannot begin; the free Starter plan remains available without restriction. This request does not affect the right of withdrawal itself, which continues for fourteen days.
The proportionate amount is calculated from the agreed total price of the selected billing period. The provider excludes days of a free trial (§ 5(2)) from this calculation and waives the proportion otherwise due for those days. As evidence, the provider records the time and version of the declaration as an attribute of the contract with the payment service provider and in the user account.
The provider confirms the contract by email to the user account address promptly after it is concluded. The confirmation includes the content of the contract, this information on withdrawal, the model withdrawal form and the user's declaration requesting an immediate start of service (§ 312f(2) BGB).
Model withdrawal form
(If you wish to withdraw from the contract, please complete and return this form.)

(1) A monthly subscription may be cancelled at any time with effect from the end of the current billing period.
(2) Half-yearly and annual subscriptions may be cancelled at any time with effect from the end of the relevant term. If they are not cancelled by the end of that term, they continue for an indefinite period; the provider continues to collect payment in advance for each billing period. After continuation, the user may cancel at any time on one month's notice; within fourteen days, the provider refunds any payment already collected for the period after cancellation takes effect, using the original payment method. The right of withdrawal under § 6 remains unaffected.
(3) Cancellation is available in the Platform's account settings, by email to amos@am-creativetech.com or through the ‘Cancel contracts here’ button. This button appears in the footer of public pages and in the account profile area and is accessible without signing in (§ 312k BGB).
(4) A cancellation submitted through that button is received by the provider when the form is sent; that time is decisive. The provider identifies the contract using the email address supplied, ends it at the earliest possible date and promptly emails that address a confirmation of the notice's content, its date and time of receipt, and the contract end date. If the notice cannot be matched automatically, the provider states this in the confirmation, matches it manually and supplies the contract end date within two working days; the notice remains valid with its recorded time of receipt. An email to amos@am-creativetech.com is equally sufficient.
(5) Following cancellation of a paid subscription, the user retains access to all paid features until the end of the paid period. The account then automatically switches to the free Starter plan.
(6) Data processing when changing plans (paid plan to Starter ): When switching from Essential or Performance to the Starter plan, your own topics and cards exceeding the Starter limits are locked, rather than being automatically published or deleted. They become available again after a subsequent upgrade. Publication is a separate, voluntary action by the user (see § 14). Decks already shared publicly remain public until the user withdraws that sharing permission.
(1) The user receives a non-exclusive, non-transferable right to use the Platform for the duration of the contractual relationship.
(2) Content created by the user (flashcards, notes and formulas) remains the user's property. The provider receives a limited right to use it to provide the service, for example for storage, display and AI processing.
(3) The Platform, its design, its software and all associated content are protected by copyright and owned by AM Creative Tech UG.
(1) In the ‘Materials’ area, users may store their own learning documents (PDF files or images) in their accounts, generate an AI summary from them and use them as a starting point for flashcards or quiz questions. The number and size of documents may be limited according to the plan.
(2) Users may upload only material they are entitled to store and process; § 9 applies accordingly. The licence granted under § 8(2) applies to uploaded materials and is limited to providing the features (storage, display and AI processing). Materials are not published; § 14 remains applicable to Community content shared separately.
(3) Materials removed individually first remain in the trash for 30 days and can be restored during that time. They continue to count towards storage. Explicitly confirmed permanent deletion removes the original file, summary and derived text artefacts from active storage; private source references in existing cards and tests remain as provenance information. Future automatic cleanup of original materials in free accounts unused for at least 24 months is currently disabled. The rule and its introduction will be communicated before activation. Deletion will take place no earlier than 90 days after a personal advance notice has been successfully delivered, with reminders 30 and seven days beforehand. Active paid subscriptions, trials and school accounts are excluded. New activity stops an announced cleanup. Missing activity history will be treated conservatively from introduction; after paid access ends, an additional grace period of at least 90 days applies. This cleanup does not delete learning content, the account or billing records. Account deletion removes active materials through the existing resumable deletion process; the 30-day trash period does not delay it. Technical soft-deletion and backup periods remain unaffected and are described in the Privacy Policy. The Platform is not a backup service; users remain responsible for their own backups of original files.
(1) The podcast feature lets users generate a script from selected materials and learning content of their own, have it voiced with AI voices, make their own recordings or add their own audio files, and convert recordings to text. The feature is available only to accounts for which the provider has enabled it; there is no entitlement to activation. Scope and allowances may be limited per account.
(2) Users may record and add only audio they are entitled to store and process; § 8a(2) and § 9 apply accordingly. If other people can be heard, users must obtain their consent beforehand. Unauthorised recording of another person's non-publicly spoken words is a criminal offence under § 201 StGB. Recording third-party lectures and classes requires permission.
(3) In the application, the provider labels tracks created with AI voices as ‘AI voice’ and users' own recordings as ‘Own recording’. The application identifies automatically recognised subtitles as such. Scripts, transcripts and subtitles may contain errors; § 15(2) and (4) apply accordingly.
(4) Deleted episodes remain in the trash for 30 days, during which they may be restored or permanently deleted; afterwards, they and their files are deleted. Section 4e of the Privacy Policy describes which services process recordings and text, where processing takes place and how long data are retained.
The user agrees:
(1) The provider has unlimited liability for intentional misconduct and gross negligence. For ordinary negligence, the provider is liable only for a breach of essential contractual obligations, limited to foreseeable damage typical of the contract.
(2) The provider does not guarantee uninterrupted availability of the Platform. Brief outages due to maintenance, server problems or force majeure may occur.
(3) The provider is not liable for the substantive accuracy of AI-generated learning content. Such content serves solely as a learning aid and does not replace professional advice. Additional provisions on AI-generated content and content sources appear in § 15.
(1) The provider may amend these Terms where there is an objective reason, such as a change in the law, a change to the scope of services or a clarification. Each version has a version number shown at the end of this document. Changes are presented to users when they next sign in to the Platform, where the full amended version is available.
(2) The amended version applies only after the user has expressly accepted it. Neither silence nor continued use constitutes acceptance. Until acceptance, the Platform cannot be used with that account. If the user does not accept, they may end the contract through the ‘Cancel contracts here’ button, which is accessible without signing in, including when Platform access for the account is blocked (§ 7(3)). The provider refunds a proportionate amount of any prepaid fee for the period from rejection until the contract ends; an email to amos@am-creativetech.com is sufficient. The provider records acceptance, together with the version number and time, in the user account. This paragraph does not apply to accounts under § 16(5).
(3) The provider may change the scope of a paid plan beyond what is necessary to maintain conformity only for a valid reason, without additional cost to the user, and after giving reasonable advance notice in text form of the nature, timing and reason for the change. If the change affects usability more than insignificantly, the user may end the contract without notice within thirty days of receiving the notification; the provider refunds prepaid fees for the period thereafter (§ 327r BGB).
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) If the user is a merchant, a legal entity under public law or a special fund under public law, Dresden is the exclusive place of jurisdiction.
(3) If any provision of these Terms is or becomes invalid, the validity of the remaining provisions is unaffected.
(1) To maintain the Platform's quality, stability and economic viability, the provider collects anonymised and user-related usage statistics. The data collected include, in particular:
(2) These data are collected to optimise Platform performance, identify and prevent abuse, plan AI service costs and improve the user experience. Processing is based on Art. 6(1)(b) GDPR (performance of a contract) and Art. 6(1)(f) GDPR (the provider's legitimate interests).
(3) Usage data are used only internally by the provider and are not passed to third parties for advertising. Data are disclosed to third parties only where technically necessary to provide the service. The following subprocessors are used:
Depending on the service, data may also be processed in third countries. Detailed information on processing, recipients and the safeguards used is available in the Privacy Policy.
(1) Users may publish their own topic sets as public Community decks. Imported Community decks and school/teacher copies are excluded. A published deck is accessible at a random public URL ( { quanta-study.de/deck/[ID] } ). The following conditions apply:
(2) Publication requires an active user action. For the first onboarding topic, users may voluntarily select an unchecked checkbox agreeing that the topic, flashcards and multiple-choice tests will be published after generation; without consent, the topic is created privately. Consent applies only to this first topic. Other topics and their multiple-choice tests are published only through their own sharing controls.
(3) Questions or requests to erase public deck content may be sent to: amos@am-creativetech.com .
(1) The Platform uses AI to generate flashcards and multiple-choice tasks. Generation is grounded in sources: the provider uses open educational sources or documents and references supplied by the user (§ 8a) and identifies the source used for each generated card in the application. This does not cover content users create or import themselves. Content generated before this workflow was introduced remains labelled accordingly in the application.
(2) Despite source attribution, the provider gives no warranty that generated content is substantively accurate, complete or up to date. No card is created without a source. Every flashcard or multiple-choice generation starts from a source: open educational material, a user's document or a reference supplied by the user (§ 8a). For generation from educational sources, the provider discards content that cannot be supported by the source consulted and does not show it to the user. For generation from an uploaded document or reference, the document or linked page itself is the source; the provider does not discard content in that case, but identifies its provenance on each card. A successful comparison between the quoted evidence and extracted text is shown separately on the card; where that check is absent, for example because text recognition was incomplete or the card contains formulas, only provenance information is shown. For flashcards and multiple-choice tasks, there is no fallback to model knowledge without any source. By contrast, the learning tutor, mock examination (exam simulation), card explanations and elaborations, and word-search, matching and cloze tasks in the school area use the relevant card's content or the language model's knowledge and carry no source evidence; they are labelled as AI output under paragraph 4. Users must check content independently before using it. This applies particularly to safety-, health- or law-related content, for example in medicine or law, which does not replace professional advice.
(3) Some content is generated from openly licensed sources. An overview of the content sources and their applicable licences is available under Licences . Where content comes from sources subject to a share-alike licence, such as CC BY-SA, the relevant licence's distribution terms apply, particularly attribution and distribution under the same terms. Users must observe these conditions if they reuse content outside the Platform.
(4) Transparency under Art. 50 of Regulation (EU) 2024/1689 (AI Act). Users interact with an AI system when using generation, explanations, summaries, mock examinations and the learning tutor, and when using podcast scripts, AI voices and speech recognition. These features produce artificially generated content. The provider states this directly at the relevant output in the application, particularly through labels on AI-generated flashcards and tasks, the source identified for each card (paragraphs 1 and 2) and the ‘AI voice’ label on synthetically voiced episodes (§ 8b). Separate disclosure is not omitted merely because this is already apparent from the circumstances; the provider labels the output nevertheless.
(5) Content is generated for the individual user and shown to that user; the provider does not distribute it as an editorial publication informing the public about matters of public interest. Users who publish generated content themselves outside the Platform are responsible for complying with the transparency obligations applicable to them.
(1) Educational institutions (‘Schools’) may use Quanta for their teachers and students under an institutional licence. Institutional use is governed by the agreements between the provider and the School; these Terms apply additionally where no different arrangement has been made.
(2) A School has owner, teacher and student roles with different features and administrative permissions. The School creates student accounts. Students do not need private email addresses; they sign in using an identifier generated by the system and assigned by the School.
(3) The School is the controller under the GDPR for personal data relating to its teachers and students. The provider processes those data as a processor. A separate data processing agreement under Art. 28 GDPR is concluded with the School; its provisions take precedence over these Terms for data processing performed on the School's behalf.
(4) The School ensures that the parental or guardian consents required for use by minor students are in place.
(5) The institution alone is the provider's contractual partner. Teachers and students do not make their own contractual declaration, and are not asked to accept these Terms. The institution undertakes to impose the user obligations in § 9 and the liability provisions in § 10 on them as its own rules of use before their first use. The provider makes the Terms, Privacy Policy, Imprint and licence notices accessible in every school account's profile area.
